Driving in Spain.

Contrary to what you may see on the roads in Spain, driving here is NOT:
1. Just like the UK but on the other side,
2. A free-for-all with no rules, or rules to be ignored if you're local.

The Guardia Civil and police can and do enforce traffic regulations, and can really spoil your holiday.

Inspired by Brian Deller's excellent "Motoring in Spain", this site tells you what the traffic laws are in Spain. Unlike the UK Highway Code, they are not guidelines, they are fixed... and to be obeyed.

Most Spanish road traffic law is contained in the LSV (Ley de Seguridad Vial), on which is based the RGC (Reglamentación General de Circulación) which also has the force of law. Allied to this is the RGV (Reglamentación General de Vehículos) which covers construction and use of motor vehicles.

This site is still under construction and will be quite large (over 170 articles for the RGC alone). The best place to start is the RGC index and the glossary. The RGV, and LSV will be added later when translation has been checked.

Loading and unloading operations.

Article 16. Loading and unloading operations.
Loading or unloading operations must be done off the road. Exceptionally, when unavoidable, they must be done without causing either serious danger or disturbance to other users and considering the following rules:
a) Restrictions on stopping and parking will be respected, including those in town set by the municipal authorities.
b) Loading/unloading will if possible be done from the side of the vehicle facing away from the road.
c) Will be carried out with means sufficient to minimise delay and avoid noise and unnecessary annoyance. The load must not be left in the road, roadside or pedestrian areas.
d) Loading and unloading of annoying, injurious, unhealthy or dangerous goods, as well as those that involve special handling or packaging, will be governed in addition by the relevant specific regulations.

Load Dimensions.

Article 15. Load Dimensions.
1. The load will not exceed the dimensions of the vehicle, except in the cases and conditions specified in the following sections. For vehicles drafted by animal(s), this is understood to mean the load does not overhang past the head of the animal nearest to the load, nor beyond the width of the vehicle.
2. For vehicles destined exclusively to the transport of goods, being indivisible loads and when the conditions established for their stowage and preparation are met, they may overhang:
a) In the case of beams, posts, tubes or other loads of indivisible length:
i) In vehicles of over 5m length, 2m to the front and 3m to the rear.
ii) In vehicles of up to 5m length, the third of the length of the vehicle at each end.
b) Where the lesser dimension of the indivisible load exceeds the width of the vehicle, up to 0.40m over each side, provided the total width does not exceed 2.55m.
3. For other vehicles not destined exclusively to the transport of goods the load must not overhang from the rear by more than 10% of its length, and if indivisible, by 15%.
4. For vehicles of less than 1m width the load must not overhang widthwise more than 0.50m to each side. It must not overhang to the front [at all], nor more than 0.25m to the rear.
5. When the load exceeds the load area of the vehicle, always within the limits of the previous sections, all proper precautions to avoid damage or danger to other road users must be taken, and the load must be protected where it overhangs to reduce the effects of possible scrapes or impacts.
6. In all cases, overhanging loads covered in sections 2 and 3 must be signed by means of signal V-20 referred to in Article 173 that has characteristics laid down in Annex XI of the RGV. The signal must be placed at the rear end of the load so that it is always perpendicular to the axis of the vehicle. When the load overhangs at the rear over the whole width of the vehicle, two signal panels will be placed cross-sectionally, each one on the end of the load or at the width of the material that projects. Both panels must be placed in such a way that they form an "inverted V". 7. When the vehicle is driven between sunset and sunrise or in conditions of significantly reduced visibility, the load must be signalled, in addition, with a red light. When the load overhangs the front, the signaling [to the front] must be by means of a white light.
8. Loads overhanging the sides of the load area by more than 0.40m and driven between sunset and sunrise or in conditions of significantly reduced visibility will be signalled forwards by means of a white light and a white reflecting device, and rearwards by means of a red light and a red reflecting device.
9. For vehiclular traffic covered by the special transport regime, specifications will be in the authorization.

Character of the load.

Article 14. Character of the load.
1. The load transported, as well as the accessories that are used for their preparation or protection, must be positioned and if necessary fastened in such a way that it cannot:
a) Drag, fall totally or partially or move in a dangerous way.
b) Compromise the stability of the vehicle.
c) Produce noise, dust or other disturbance that can be avoided.
d) Obscure lights, signals, plates and obligatory symbols or signals from the driver.
2. The transport of goods that produce dust or can fall will always be effected by covering them totally and effectively.
3. The transport of annoying, injurious, unhealthy or dangerous loads, as well as those that involve special preparation or packing will follow in addition, the specific rules that regulate the matter.

Dimensions of the vehicle and its load.

Article 13. Dimensions of the vehicle and its load.
1. In no case, will the length, width and height of the vehicle and its load exceed that indicated in the RGV or for the road on which they drive.
2. Transport of indivisible loads that inevitably exceed the limits indicated in section 1 must be made by means of special authorization, regulated in the RGC, according to the traffic rules and conditions set down in Annex III.
3. Infractions of this Article are an offence (LST Art 67,2).

Rules for cycles, mopeds and motorcycles.

Article 12. Rules for cycles, mopeds and motorcycles.
1. Bicycles that, by construction, cannot be occupied by more than one person may however transport, when the rider is of legal age, a child of up to seven years in an approved additional seat.
2. A passenger over 12 years old may ride on a moped or motorcycle in addition to the driver, subject to the vehicle’s Permiso de Circulación, when using an approved helmet and meeting the following conditions:
a) They sit astride and with their feet on the footrests.
b) They use the seat behind the driver. Under no circumstances may the passenger be between the rider and the controls.
3. Exceptionally, those over seven years old may ride on motorcycles or mopeds driven by their parent, tutor or by a person of legal age authorized by them, whenever they use an approved helmet and meet the conditions of section 2 (LST Art 11,4).
4. Motorcycles, three wheeled vehicles, mopeds, cycles and bicycles may tow a trailer, provided they do not exceed 50% of the unladen mass of the towing vehicle and the following conditions are met:
a) That the vehicle is driven only during daytime and in conditions of good visibility.
b) That the speed driven in these conditions is reduced by 10% with respect to the generic speeds for these vehicles laid down in Article 48.
c) Those in no case people occupy the trailer.
In town, driving will be in accordance with the corresponding local regulations.

Collective passenger transport.

Article 11. Collective passenger transport.
1. Drivers must stop and pull away without shocks or abrupt movements, and keep as close as possible to the right hand side of the road. Passengers will not distract the driver whilst the vehicle is moving. The driver or person in charge will safeguard the passengers.
2. In vehicles used for public transport, passengers are prohibited from:
a) Distracting the driver whilst the vehicle is in motion.
b) Entering or leaving the vehicle by places different from those specified.
c) Entering the vehicle when warned it is full.
d) Impeding unnecessarily access to or from the vehicle.
e) Bringing on board any animal, unless a place for its transport exists in the vehicle. Guide dogs for the disabled are excepted provided they are constantly supervised.
f) Carrying dangerous goods or objects in conditions different from that established in the specific regulations.
g) Disregarding instructions given by the driver or the person in charge of the vehicle.
The driver or person in charge of public transport vehicles can prohibit boarding and order passengers to leave who fail to fulfil the rules laid down in this section.

Passenger seating.

Article 10. Passenger seating.
1. It is prohibited to transport people in parts of the vehicle not specifically designed or adapted for that purpose.
2. Despite the arrangements in section 1, in goods vehicles, people may travel in the load space, subject to conditions laid down in the appropriate regulations.
3. In vehicles authorized simultaneously to transport people and goods, passengers must be provided with protection from the load, so that it does not impede the occupants nor damage them in case of movement. This protection must be in accordance with the RGV.
4. Protection not installed in accordance with paragraph 3 is an offence (LST Art 67,2).

Carriage of passengers.

Article 9. Carriage of passengers.
1. The number of people transported in a vehicle must not exceed the number of authorized seats it has. Those in public service and buses must have this indicated on plates placed inside. In no case can the MAM for the vehicle be exceeded, counting both travellers and luggage.
2. To calculate the number of transported people:
a) In cars, [mini]buses and mixed vehicles, children less than two years do not count if in the care of an adult other than the driver, when the child does not occupy a seat.
b) In cars, each child over two years and less than 12 counts as a normal passenger, the maximum number of seats thus computed cannot exceed 50% of the total, excluded the driver [e.g. in a normal car with five seats; four for passengers, you must not carry more than 6 passengers].
c) In vehicles authorized for school transport or for children, the limit is established in the specific legislation.
3. Infractions are very serious offences (LST Art 65.5.d). Traffic officers can immobilize the vehicle, so long as the cause of the infraction exists, (LST Art 70,3).

Vehicle loading and transport of people and goods.

Article 8. Vehicle loading and transport of people and goods.
It is prohibited to load vehicles or to transport people or goods in them differently to that specified in this chapter.
