Driving in Spain.

Contrary to what you may see on the roads in Spain, driving here is NOT:
1. Just like the UK but on the other side,
2. A free-for-all with no rules, or rules to be ignored if you're local.

The Guardia Civil and police can and do enforce traffic regulations, and can really spoil your holiday.

Inspired by Brian Deller's excellent "Motoring in Spain", this site tells you what the traffic laws are in Spain. Unlike the UK Highway Code, they are not guidelines, they are fixed... and to be obeyed.

Most Spanish road traffic law is contained in the LSV (Ley de Seguridad Vial), on which is based the RGC (Reglamentación General de Circulación) which also has the force of law. Allied to this is the RGV (Reglamentación General de Vehículos) which covers construction and use of motor vehicles.

This site is still under construction and will be quite large (over 170 articles for the RGC alone). The best place to start is the RGC index and the glossary. The RGV, and LSV will be added later when translation has been checked.

Obligation of other drivers to facilitate the maneuver

Article 73. Obligation of other drivers to facilitate the maneuver.
1. Independently of the obligation of drivers joining the traffic to fulfill the prescriptions of the previous Article, other drivers will facilitate, as far as possible this maneuver, especially if dealing with a public transport vehicle joining the traffic from a signed stopping place (LST Art 27).
2. In towns, with the purpose of facilitating the progress of public transport vehicles, drivers of other vehicles must move laterally, whenever possible, or reduce their speed, taking account of the arrangements in Article 53, stopping if necessary, so that public transport vehicles can maneuver as necessary when moving off from signed stops.
3. The arrangements in the previous section does not modify the obligation of public transport vehicle drivers to take the necessary precautions to avoid risk of accidents, after having indicated their intention to move off.

Obligations of drivers who join the traffic

Article 72. Obligations of drivers who join the traffic.
1. The driver of a vehicle stopped or parked on the road or proceeding from an access road, from its service areas or an adjacent property, who intends to join the traffic must previously check, including following the indications of another person if necessary, that it can be done without danger to other users, giving way to other vehicles and considering their position, direction and speed, and will indicate using the appropriate obligatory signals. If the road being joined has an acceleration lane, the driver who joins must do so by adapting their speed to the road (LST Art 26).
2. Whenever a driver joins a public road from a private access, he must previously ensure it can be done without endangering anyone and to do so at a speed that allows him to stop in the act, giving way to vehicles on the public road in both directions.
3. Drivers who join the traffic will indicate the maneuver in the form described in Article 109.
4. On roads with an acceleration lane, drivers of vehicles who intend to use it to join the road must ensure at the beginning of the lane, that they can do so without endangering other users on the road, considering their position, direction and speed, stopping if necessary. Next, they will accelerate up to a speed adapted to join the traffic at the end of the acceleration lane.
5. Joining the traffic without giving way to other vehicles will be treated as a serious offence (LST Art 65.4.c)).

special vehicles and transport

Article 71. Traffic and signalling rules.
1. The rules in Annex III of this regulation apply, in addition to the general rules where applicable.
Special vehicles may only use the roads subject to the traffic legislation to travel, irrespective of the tasks for which they are destined based on their technical characteristics, except where carrying out road construction, repair or maintenance exclusively in the areas of these works or where specifically equipped to tow damaged, broken down or badly parked vehicles. Special vehicles may not transport loads, except if specifically designed to do so, for which they must have the appropriate authorization.
Drivers of special vehicles and exceptionally, others, used for road construction, repair or maintenance, are not required to observe the traffic rules, whenever they are carrying out works in the designated area, but must take the necessary precautions and ensure traffic is properly regulated.
2. Whilst working, drivers of works or service vehicles must use luminous signal V-2 referred to in Article 173.2:
a) When interrupting or obstructing traffic, to indicate their position to other users, the vehicle is specifically equipped to tow damaged, broken down or badly parked vehicles.
b) When carrying out cleaning, maintenance, signaling or road repair operations, to indicate their position to other users; if on an autopista or autovía, special vehicles must also use the signal from their entry to their arrival at the place where the works are carried out.
3. Whilst travelling, drivers of special vehicles or covered by the special transport regime must use the signal during the day as well as at night, whenever travelling on public roads at a speed not exceeding 40kph. In case of signal failure, dipped headlights and hazard lights must be used together.
4. Infractions of this article as far as the obligation to have the flashing light installed in the vehicle will be sanctioned in accordance with the arrangements in the LST Art 67,2.

Non high-priority vehicles in emergency service

Article 70. Non high-priority vehicles in emergency service.
1. If, as a result of specially serious circumstances, the driver of a non high-priority vehicle is required, without being able to resort to another means, to carry out a service normally reserved to high-priority vehicles, they must ensure that other users are aware of the special situation whilst travelling by means of using the horn intermittently and using the hazard lights, if available or waving a handkerchief or similar procedure.
2. Drivers referred to above must respect the traffic rules, above all at intersections, and other users of the road will abide by the arrangements in Article 69.
3. At any time, traffic officers may demand justification of the circumstances referred to in section 1.
4. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Behavior of other drivers with respect to high-priority vehicles

Article 69. Behavior of other drivers with respect to high-priority vehicles.
As soon as they perceive the signals that indicate the approach of a high-priority vehicle, other drivers must take the necessary measures, according to the circumstances of the time and place, to facilitate the passage of the emergency services, normally moving to their right right or stopping if necessary.
When a police vehicle, marking its presence according to the arrangements in Article 68,2 is behind any other vehicle and uses in addition its flashing yellow lights, the driver in front must stop with due precaution on the right hand side, in front of the police vehicle, in a place where they do not create greater risk or annoyance to other users, and must remain in the vehicle. At all times the driver will obey the instructions of the traffic officer.

Faculties of drivers of high-priority vehicles

Article 68. Faculties of drivers of high-priority vehicles.
1. Drivers of high-priority vehicles must observe the rules of this regulation, although where assured that they do not endanger any road user, they need not obey the rules of titles II, III and IV, except for orders and signals of traffic officers, which they must always obey.
Drivers of these vehicles may also exceptionally, when travelling along an autopista or autovía in an emergency and not jeopardizing the safety of any user, make U-turns, reverse, travel against the traffic flow on the hard shoulder, use the median strip or emergency crossing areas.
Traffic officers may use or put their vehicles in the part of the road that is necessary when helping other users or traffic. They will also determine in each circumstance the location of emergency service vehicles or other special services.
2. High-priority vehicles include police, fire service, civil protection and rescue, and medical assistance (public or private), in emergency service and whose drivers warn of their presence by means of flashing lights desbribed in Article 173 and sirens described in the RGV.
Exceptionally to the previous paragraph, drivers of the high-priority vehicles may use flashing lights separately without sirens where this does not involve any danger to other users.
3. Infractions of this Article are considered serious offences (LST Art 65.4.c).

High-priority vehicles

Article 67. High-priority vehicles.
1. Vehicles in emergency service have priority over other vehicles and users of the road. They may travel over the speed limits and are exempt from other rules or signals in the cases and in the conditions determined in this section (LST Art 25).
2. Drivers of emergency vehicles will use sirens or flashing lights solely when travelling in an emergency and will take not to ignore the right of way at intersections or traffic lights, without first adopting extreme precautions, ensuring that there is no risk of running over pedestrians and that drivers of other vehicles have stopped or facilitate their passage.
3. Installation of flashing lights and sirens in high-priority vehicles will require authorization of the Provincial Headquarters of corresponding Traffic, in accordance with the arrangements in the RGV.

Right of way of drivers over animals

Article 66. Right of way of drivers over animals.
1. Drivers have right of way with respect to animals, except in the following cases:
a) On properly signed animal tracks (cañadas).
b) When turning to enter another road and there are animals crossing it, although no crossing exists.
c) When the vehicle crosses a hard shoulder along which animals are travelling and there is no cañada (LST Art 23,4).
2. Cañadas or animal crossings are generally signalled by means of complementary panels with the inscription "cañada", placed under the signal "domestic animal crossing", described in Article 149, perpendicular to the direction of traffic and the obverse side easily visible to drivers. This signalling must be complemented by the corresponding speed limit sign.
3. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Right of way of Drivers over pedestrians

Article 65. Right of way of Drivers over pedestrians.
1. Drivers have right of way with respect to pedestrians, except in the following cases:
a) On properly signed pedestrian crossings.
b) When turning to enter another road and are pedestrians crossing it, although no crossing exists.
c) When the vehicle crosses a hard shoulder along which pedestrians are travelling and there is no pedestrian area (LST Art 23,1).
2. In pedestrian areas when vehicles cross them using designated crossings, drivers are obliged to let pedestrians pass (LST Art 23,2).
3. Also they have to give way to:
a) Pedestrians who are boarding or leaving a public transport vehicle at a signed stop, between the vehicle and a pedestrian zone or refuge.
b) Troops in formation, schoolchildren or organized processions (LST Art 23,3).
4. Infractions of this Article are considered serious offences (LST Art 65.4.c).

General rules and right of way of cyclists

Article 64. General rules and right of way of cyclists.
As a general rule, and whenever their routes cross, drivers have right of way on the road and hard shoulder with respect to pedestrians and animals, except in the cases described in Articles 65 and 66, where they must let them pass, stopping if necessary. Bicycle riders have right of way with respect to motor vehicles:
a) When using a cycle lane, cycle crossing or hard shoulder properly signed.
b) When a motor vehicle turns right or left to enter another road, and a cyclist is near.
c) When circulating as a group and the first cyclist has started crossing or has entered a roundabout.
In other cases the general rules apply on right of way between vehicles.

Steep gradients

Article 63. Steep gradients.
1. On steep gradients which are narrow in the sense of Article 60, the priority is with the ascending vehicle, except if the ascending vehicle first arrives at a designated passing place. In case of doubt on the gradient or distance to the passing place, refer to Article 62 (LST Art 22,2).
Steep gradients are defined as having a minimum slope of 7%.
2. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Priority in the absence of signaling

Article 62. Priority in the absence of signaling.
1. Without prejudice to that which traffic officers can order or, where appropriate, works personnel or support personnel of special vehicles or vehicles in the special transport regime, the priority between the different types of vehicles where one must reverse is as follows:
a) Special vehicles also under the special transport regime of that exceed the masses or dimensions established in the vehicle regulations.
b) Vehicle combinations, except those described in paragraph d).
c) (Animal) draft vehicles.
d) Cars towing trailers of up to 750 kg MAM and motor homes.
e) Vehicles for the collective transport of passengers.
f) Trucks, tractor cabs and vans.
g) Cars and vehicles derived from cars.
h) Special ehicles that do not exceed the masses or dimensions established in the vehicle regulations, quadricycles and light quadricycles.
i) Three wheeled Vehicles, motorcycles with sidecar and three wheeled mopeds.
j) Motorcycles, two wheeled mopeds and bicycles.
When dealing with vehicles of the same type or not listed above, priority will be decided in favor of that which it has to reverse the greater distances and, in case of equality, that which it has the greater width, length or MAM.
2. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Passage of bridges or signed road works

Article 61. Passage of bridges or signed road works.
1. Priority over bridges or through road works whose width does not allow passing of vehicles is done according to the regulating signaling.
2. In cases where two vehicles meet that cannot pass in bridges or road works where at one of whose ends a signal giving priority to oncoming traffic has been placed or a “give way” sign, the vehicle arriving from that end must reverse to allow traffic to pass. In the absence of signaling, the order of preference of different types of vehicles is laid out in Article 62.
3. Vehicles needing special authorization to travel may not use bridges less than 6m wide, (each carriageway is counted as 3m width). Where such vehicles meet the arrangements in the previous section apply.
4. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Road works and narrows

Article 60. Road works and narrows.
1. Where the road by its narrowness it is very difficult or impossible for traffic to pass simultaneously, where there is not express signaling to the effect, traffic that enters first will have priority (LST Art 22,1).
If in doubt, the vehicle with greater difficulty of maneuver has right of way, in accordance with Article 62.
2. When road repair works are taking place, vehicles and animals will travel by the route indicated.
3. If possible to do so without danger or damage to the road works, the road under repair may be used by the emergency services on call provided the drivers so indicate by means of the corresponding signaling.
4. In every case, vehicles approaching road works with traffic waiting in front, must stay behind the vehicle in front, as close to the right hand side as possible, and must not try to overtake or pass but follow the traffic ahead.
5. In all the cases described in this Article, the users of the road are required to follow the directions of the authorised personnel.
6. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Intersections

Article 59. Intersections.
1. Even where priority exists, no driver may enter an intersection or a crossing reserved for pedestrians or cyclists if the traffic situation is such that, foreseeably, there may be a delay that prevents or obstructs crossing traffic (LST Art 24,2).
2. Any driver delayed in an intersection regulated by traffic lights and causing an obstacle to traffic must leave the intersection without waiting for the correct signal, provided it does not obstruct it the progress of other users who are travelling correctly (LST Art 24,3).
3. Infractions of this Article are considered serious offences (LST Art 65.4.c).

General rules

Article 58. General rules.
1. Vehicles that have to give way to other traffic must not move off or continue on their way, until they have assured that they will not force other vehicles with priority to abruptly modify their direction or speed, must indicate with sufficient notice, by their manner of driving and especially by the gradual reduction of their speed that indeed they are going to give way (LST Art 24,1).
2. In all cases the rules of this chapter that regulate priority drivers must consider the rules described in the previous section.
3. Infractions of this Article are considered serious offences (LST Art 65.4.c).

Unsigned Intersections

Article 57. Unsigned Intersections.
1. In defect of signals that indicate priority, the driver is required to give way to vehicles approaching from the right, except in the following cases:
a) They have right of way over vehicles that approaching a made road from an unmade road.
b) Vehicles on rails have right of way over other users.
c) On roundabouts, those that are on the roundabout will have priority over joining traffic (LST Art 21,2).
d) Vehicles on an autopista or autovía have priority over joining traffic.
2. Infractions of this Article are considered serious offences (LST Art 65.4.c).

RULES OF PRIORITY AT INTERSECTIONS

Article 56. Signed intersections.
1. At intersections the right of way will always be signalled (LST Art 21,1).
2. Vehicles approaching an intersection regulated by a Traffic Officer must stop if ordered to do so by means of signals specified in Article 143.
3. Vehicle approaching an intersection regulated by traffic lights must act in the way specified in Article 146.
4. Vehicles approaching a signed intersection with priority, or driving on a signed priority road, described in Articles 149 and 151, will have priority over vehicles on other roads or joining from them.
5. At intersections with “give way” or “stop” signs, described in Articles 151 and 169, drivers will always give way to vehicles travelling on the priority road, whichever direction they approach from, stopping if necessary or if so signed.
