Driving in Spain.

Contrary to what you may see on the roads in Spain, driving here is NOT:
1. Just like the UK but on the other side,
2. A free-for-all with no rules, or rules to be ignored if you're local.

The Guardia Civil and police can and do enforce traffic regulations, and can really spoil your holiday.

Inspired by Brian Deller's excellent "Motoring in Spain", this site tells you what the traffic laws are in Spain. Unlike the UK Highway Code, they are not guidelines, they are fixed... and to be obeyed.

Most Spanish road traffic law is contained in the LSV (Ley de Seguridad Vial), on which is based the RGC (Reglamentación General de Circulación) which also has the force of law. Allied to this is the RGV (Reglamentación General de Vehículos) which covers construction and use of motor vehicles.

This site is still under construction and will be quite large (over 170 articles for the RGC alone). The best place to start is the RGC index and the glossary. The RGV, and LSV will be added later when translation has been checked.

Visibility from the vehicle.

Article 19. Visibility from the vehicle.
1. Vehicle windows must allow at all times a clear view by the driver of the entire road around, without interferences from stickers or the like.
Shades against the sun in the rear windows of the vehicle are only allowed when the vehicle has two outside rear view mirrors that meet the necessary technical specifications.
However, certain adhesive stickers are allowed in those conditions established in the RGV [e.g. ITV sticker].
Positioning of vehicle signs in the transport legislation or other regulations must be done so that they do not restrict the driver’s vision.
2. Unapproved tinted or colored glass is prohibited.
3. Infractions will be sanctioned in accordance with the LST Art 67,2.

Other driver’s obligations.

Article 18. Other driver’s obligations.
1. The driver must maintain his own freedom of movement, the necessary field of vision and permanent attention to driving that guarantee their own safety, that of the rest of the occupants of the vehicle and that of other road users. The driver must therefore take care to maintain the correct driving position, that passengers are properly seated, and that objects or transported animals are properly loaded so that none of them interfere with the driver (LST Art 11,2). The use by the driver with the vehicle in motion of devices such as screens with access to the internet, television monitors and video or DVD players is considered incompatible with obligatory permanent attention to driving. Excepted are the use of monitors in the driver’s field of vision and whose use is necessary for reversing, as well as GPS devices.
2. It is prohibited to drive and use helmets or earpieces connected to audio devices, except during a motorcycle driving test.
The use is prohibited whilst driving of mobile telephony devices and any other means or system of communication, except when the the communication takes place without using hands or accessories (LST Art 11,3).
Exempt from this prohibition are agents of the authorities in the exercise of their official duties (LST Art 11,3).
3. It is prohibited to fit, carry or use in vehicles, devices prepared or designed to elude monitoring by traffic officers, or that emit or make signals with this purpose, as well as the use of radar detection equipment.

Control of the vehicle or animals.

Article 17. Control of the vehicle or animals.
1. Drivers must at all times be in control of their vehicle or animals. When approaching other road users, they must adopt the necessary precautions for their safety especially in the case of children, the elderly, blind or other people manifestly disabled (LST Art 11,1).
2. Drivers of horses, cattle and draft vehicles must not let them run in the road close to others of the same species or to people on foot, nor abandon their driving, leaving them to wander freely or stop in the road.

Emissions, noise and polluting agents.

Article 7. Emissions, noise and polluting agents.
1. Vehicles are prohibited to emit electromagnetic disturbances, noise, gases or smoke exceeding the established limits. All drivers of vehicles are required to collaborate in the detection tests that allow checking of possible indicated deficiencies.
2. Motor vehicles and mopeds with so-called “open pipes” are prohibited, i.e. without the mandatory silencer. Vehicles must not be driven with defective, inadequate or incomplete exhaust systems, or if they expel unburnt fuel or produce excessive smoke. Traffic officers can immobilize vehicles in the above cases (LST Art 70,2).
3. Emissions under section 1 are also prohibited by motor vehicles over the established limits in the RGV regulating rules of the vehicles.
4. Emissions other than those produced by the vehicle are also prohibited, of whatever nature, over the limits established. In particular sweepings, rubbish and refuse on the road or roadside, and anywhere else when danger exists that smoke produced by their incineration or burning can reach the highway.

Fire prevention

Article 6. Fire prevention.
1. It is prohibited to throw onto the road or in its environs any object that can cause a fire or cause a danger to road safety (LST Art. 10,4).
2. Infractions are treated as serious offences (LST Art 65.4.b).

Signaling of obstacles and dangers.

Article 5. Signaling of obstacles and dangers.
1. Whoever creates on the road some obstacle or danger must remove it as quickly as possible, and must take the necessary measures in the process so that it is signalled to other users and so that traffic is not impeded (LST Art 10,3).
2. Obstacles in the road will not be considered as such in pedestrian crossings, provided they meet the regulations of the Ministry of Public Works and the Economy and that the safety of users, in particular cyclists, is guaranteed.
3. In order to signal the presence in the road of any obstacle or danger, the person causing it must signal it in an effective way, at all times, in accordance with the arrangements in Articles 130,3, 140 and 173.
4. All works that require the services of mechanical help, health or any other type of intervention must be governed by the principles of use of the suitable and strictly necessary resources in each case. The competent authority will decide the presence and permanence in the area of all any personnel and equipment that is essential and they will ensure the absence of unauthorised from the works; in addition, they will indicate in each case where emergency service vehicles or other special services are to be located.
5. The actions of the emergency services, as well those of recovery and breakdown services and those of highway maintenance, will try to cause the least possible disturbance to other traffic, occupying the minimum amount of road and following at all times the instructions of the competent authority. The behavior of drivers and users in case of emergency will be in accordance with Articles 69, 129 and 130 and, in particular, drivers of emergency service vehicles, in accordance with the arrangements in Articles 67, 68, 111 and 112.
6. Stopping or parking of the vehicles belonging to the mentioned services will take place so that it does not create a new danger, and where it causes the least disruption to the traffic.
7. Stopping or parking in places other than those designated by traffic officers are treated as serious offences in accordance with the (LST Art 65.4.d).

Activities that affect traffic safety.

Article 4. Activities that affect traffic safety.
1. The carrying out of works, etc. of permanent or provisional nature in the road or land subject to the application of the legislation needs the previous authorization of its owner and will be governed by the arrangements in the law. The same rules apply to the interruption of works at the request of the relevant Jefatura Central de Tráfico (LST Art. 10,1).
2. It is prohibited to leave on the road objects or materials that can obstruct traffic, stopping or parking, make it dangerous or damage it or its facilities (LST Art. 10,2).
3. It is prohibited to install in roads or lands subject to the scope of application of the law any apparatus, installation or construction, or carry out activities such as filming, surveys or tests, even though of provisional or temporary character, that can obstruct traffic.

Drivers

Article 3. Drivers.
1. Drivers are required to be diligent and take all necessary precautions to avoid any damage to their own or others property, nor endanger themselves, other occupants of the vehicle or other road users. It is absolutely prohibited to drive in a negligent or reckless way (LST Art. 9,2).
2. Negligent driving is a serious offence and reckless driving a very serious offence.

Users

Article 2. Users.
Road users must not obstruct traffic illegally nor cause danger, injury or unnecessary annoyance to people, nor damage to property (LST Art. 9,1).

Scope of application of the law.

Article 1. Scope of application.
1. The law applies in all of Spain, to owners and users of public roads and land suitable for traffic, also to private roads and land in common use.
4. In the absence of other rules, owners of private land not open to public use located in urbanizations, hotels, clubs and other places of recreation, may regulate traffic in such a way as not to weaken the rules of this regulation, nor cause confusion with them.
